How Do Filipino Maids Come to the Chinese Mainland

菲佣，作为来自菲律宾的专业家政服务人员，在国际上享有一定的声誉。那么，菲佣是如何来到中国大陆的呢？

Filipino maids, as professional domestic service personnel from the Philippines, enjoy a certain reputation internationally. So, how do Filipino maids come to the Chinese mainland?

首先，公安部正式批复同意广东省的 16 项出入境政策措施，其中一项是允许全省范围内外籍高层次人才和港澳台高层次人才聘雇外籍家政服务人员，满足其家庭生活需求。这为菲佣合法进入广东提供了一定的途径。

Firstly, the Ministry of Public Security officially approved 16 entry and exit policy measures in Guangdong Province. One of them allows high-level foreign talents and high-level talents from Hong Kong, Macao and Taiwan in the province to employ foreign domestic service personnel to meet their family life needs. This provides a certain way for Filipino maids to legally enter Guangdong.

然而，需要注意的是，我国《出境入境管理法》规定，“外国人未按照规定取得工作许可和工作类居留证件在中国境内工作的属于非法就业”。目前，国内的菲佣大多处于法律灰色地带。

However, it should be noted that according to China's "Exit and Entry Administration Law", "Foreigners who work in China without obtaining work permits and work-type residence certificates in accordance with regulations are considered illegal employment". At present, most Filipino maids in China are in a legal gray area.

现在国内大部分菲佣是之前持旅游签过来的。旅游签的有效期很短，一般半个月以后签证就到期了，而她们就这样留在中国，在雇主家中工作。还有一小部分菲佣是持商务签证过来的，一般这样的签证是挂靠在企业名下的，有最少聘用并缴纳五名员工社保资质的企业法人来出具商业邀请函，为菲佣办理这种签证，要求比较高，办理周期长，一般在两到三个月，有效期为 6 个月，期满以后可以再出入境一下，然后续签 6 个月，总共可以保留一年的有效期。

Generally, the visa expires after half a month, and they stay in China and work in the employer's home like this. A small number of Filipino maids come with business visas. Generally, such visas are affiliated with enterprises. Corporate legal persons with the qualification to employ and contribute social security for at least five employees issue business invitations to handle such visas for Filipino maids. The requirements are relatively high, and the processing period is long, usually two to three months. The validity period is six months. After the expiration, they can enter and exit again, and then renew the visa for another six months. The total validity period can be one year.

菲佣进入中国“曲线就业”主要为两条途径：一是以教师或是以引进菲律宾籍培训师，实际上提供家政服务；另一条途径，也是绝大多数菲佣进入内地采用的方式，就是跟随雇主拿到旅游签证、商务签证或是名义上受雇于雇主所在的公司，从而办理到工作签证。

The "curved employment" of Filipino maids entering China mainly has two ways: one is to be a teacher or introduce Filipino trainers, actually providing domestic services; the other way, which is also the way most Filipino maids adopt to enter the mainland, is to follow the employer to obtain a tourist visa, business visa or be nominally employed by the employer's company to obtain a work visa.

但需要明确的是，在中国大陆，雇用菲佣从事家政服务存在诸多法律风险和不确定性。雇主在考虑雇用菲佣时，务必谨慎权衡利弊，遵守相关法律法规。
