违法建设,指未经规划土地主管部门批准,未领取建设工程规划许可证或临时建设工程规划许可证,擅自建筑的建筑物和构筑物。在城市规划区内,未取得建设工程规划许可证件或者违反建设工程规划许可证的规定进行建设,严重影响城市规划的,由县级以上地方人民政府城市规划行政主管部门责令停止建设,限期拆除或者没收违法建筑物、构筑物或者其他设施;影响城市规划,尚可采取改正措施的,由县级以上地方人民政府城市规划行政主管部门责令限期改正,并处罚款。
违法建设主要包括以下几类:
未取得建设工程规划许可证或者未按照建设工程规划许可证的规定进行建设的;
擅自改变建设工程规划许可证确定的使用性质进行建设的;
临时建筑物、构筑物超过批准期限不拆除的;
法律、法规规定的其他属于违法建设的行为。

English Perspective
Illegal construction refers to buildings and structures constructed without approval from the planning and land authorities, without obtaining a construction project planning permit or a temporary construction project planning permit. Within urban planning areas, any construction that has not obtained a construction project planning permit or violates the provisions of the construction project planning permit, seriously affecting urban planning, shall be ordered to stop construction, demolished or confiscated within a time limit by the urban planning administrative authorities at or above the county level. If the construction affects urban planning but corrective measures can still be taken, the urban planning administrative authorities at or above the county level shall order the correction within a time limit and impose a fine.
The main categories of illegal construction include:
Construction without obtaining a construction project planning permit or in violation of the provisions of the construction project planning permit;
